Terms and Conditions

1. General Provisions

These Terms and Conditions define the rules for using the online store available at avecriviera.com (hereinafter: the “Store”).

The Store is operated by Avecfashion, conducting business in the Netherlands, registered in the KvK 67051537 under number NL002475497B45, with its registered office at Burgemeester Panislaan, 5056AD Berkel-Enschot, NL002475497B45, hereinafter referred to as the “Seller”.

2. Definitions

Client – a natural or legal person, or an organizational unit, making purchases in the Store.

Consumer – a natural person making a purchase for purposes not directly related to their business activity.

Product – a physical item offered in the Store, including standard, preorder, and custom products.

Preorder product – a Product temporarily out of stock that can be ordered and paid for in advance. The Product will be shipped as soon as it becomes available.

Custom product – a Product made to special order based on individual arrangements with the Client.

Sales Agreement – an agreement concluded between the Client and the Seller at a distance through the Store.

3. Placing Orders

Orders can be placed via the Store website by adding Products to the cart and completing the order form.

The Store offers three types of Products:

  • Standard products – available in stock and shipped after the order is confirmed.

  • Preorder products – temporarily unavailable items that can be ordered and paid for in advance. By placing a preorder, the Client agrees to receive the Product once it becomes available. The estimated availability or shipping date is provided in the product description or confirmed by email after purchase.

  • Custom products – made to special order. The Client submits an inquiry through the contact form. The Seller agrees on the details (materials, colors, personalization), and after approval, the Seller creates a dedicated listing in the Store for the Client to place an order.

The sales agreement is concluded at the moment the Seller confirms acceptance of the order.

The Seller reserves the right to refuse an order in justified cases (e.g., non-payment or incorrect data).

4. Prices and Payments

All prices in the Store are gross prices (including VAT, if applicable).

Available payment methods: bank transfer, electronic payment, credit card, or other methods offered in the Store.

Price changes do not apply to orders already placed.

Custom products:

  • A non-refundable deposit of 50% of the order value is required to start production.

  • The remaining balance must be paid before the product is shipped.

5. Delivery

Products are shipped to the address provided by the Client.

Delivery is carried out via courier or postal services, depending on the Client’s choice.

Shipping costs are provided during order placement.

Order fulfillment times:

  • Standard products: from 3 to 5 business days, unless otherwise specified.

  • Preorder products: shipping takes place once the Product becomes available. The Seller will inform the Client when the order is ready for dispatch. If the order contains several items with different availability dates, it may be shipped together once all Products are in stock, unless agreed otherwise.

  • Custom products: standard production time is 4–6 weeks, with the exact completion date confirmed individually.

For international shipments, the Client is responsible for any customs duties and taxes in the destination country.

All Products sold in the Store are covered by a 6-month warranty provided by the Seller, as described in Section 7.

6. Withdrawal from the Agreement (Right of Return)

A Consumer has the right to withdraw from the agreement within 14 days of receiving the Product, without giving any reason.

To exercise the right of withdrawal, the Client should inform the Seller by email or via the contact form.

The Client must return the Product in an unchanged condition within 14 days of notifying the withdrawal.

Refunds will be processed within 14 days of receiving the returned Product.

The Client bears the cost of returning the Product.

Custom and preorder products cannot be returned due to their personalized or made-to-order nature.

7. Complaints

The Seller is obliged to deliver products free from defects.

All Products are covered by a 6-month warranty from the date of delivery.

The warranty covers material and manufacturing defects that occur during normal use of the Product.
The warranty does not cover damage resulting from improper use, lack of maintenance, mechanical damage, or natural wear and tear.

Complaints or warranty claims can be submitted by email or via the contact form.

Complaints concerning standard products are processed within 14 days.
Complaints concerning custom or preorder products regarding manufacturing defects must be reported within 3 days of receipt.

If the complaint is accepted, the Seller will repair or replace the Product free of charge. If repair or replacement is not possible, the Seller will refund the purchase price.

8. Personal Data (GDPR)

The administrator of the Client’s personal data is Avecfashion.

Personal data is processed for the purposes of order fulfillment, Client communication, handling complaints, and invoicing.

Providing personal data is voluntary but necessary for order processing.

The Client has the right to access, correct, request deletion, restrict processing, and transfer their data.

Data is not shared with third parties except for companies handling shipping or payment processing on behalf of the Seller.

9. Final Provisions

These Terms and Conditions are effective from 4 November 2025.

The Seller reserves the right to amend the Terms and Conditions, which do not affect orders placed prior to the changes.

Matters not regulated in these Terms and Conditions are governed by the law of the European Union and Dutch law.

All disputes will be resolved amicably, and in the absence of agreement – by the competent court.

Submitting an inquiry or placing an order (including preorder or custom product) constitutes acceptance of these Terms and Conditions, including the privacy policy and the non-returnable nature of personalized and made-to-order products.
